Expand affordable housing to fight homelessness
Litigation

Litigation & Legal Action

Use courts to enforce the right to housing or force policy change.

Bring strategic cases that challenge policies that criminalize homelessness without shelter options and that reinforce exclusionary zoning. Focus on strong plaintiffs, clear legal theories, and remedies that require governments to change practices, not just defend lawsuits. Use litigation as leverage alongside policy work so legal wins translate into real on-the-ground change.

Why this works

Court rulings can mandate reluctant cities to provide a minimum shelter or change discriminatory land use practices. A legal win can set a precedent nationwide.

Leading the movement for affordable homes for all

The National Low Income Housing Coalition (NLIHC) is a nonprofit established in 1974 and dedicated solely to achieving socially just public policy that assures people with the lowest incomes in the U.S. have affordable and decent homes. NLIHC conducts research on housing needs (like its annual Out of Reach report on the gap between rents and wages), educates the public and policymakers, and advocates for solutions to end homelessness and housing instability.

About Litigation
  1. Identify plaintiffs and facts that show concrete harm and support standing.
  2. Select the strongest legal claims and define the remedy sought.
  3. Build the record with evidence, briefs, and expert support.
  4. Prepare for appeals and enforcement so wins do not stay on paper.
  5. Track compliance after rulings or settlements until the remedy is implemented.
